Maine has "implied consent" for alcohol testing. If you refuse to take the test your driver's license is suspended for 18 months even if you are found not guilty of driving drunk. It's still better than having a DWI conviction on your record. If there is no breathalizer or other test it means the cops have one less piece of evidence to use against you in court.

I'm originally from Maine and I left behind an OUI years ago when it wasn't as strict. I'll tell you right now that the laws there now are severe.
On the other side of the coin, Maine is strapped for cash like any other state... maybe even more so.
Crime isn't as prevalent as it is in more of the populated cities and states. They will pull you over just because your the only vehicle on the street that late at night. Especially if your driving a fancy car. If Sally's rights were not violated, she refused to be tested and the police officer testifies that he observed signs of intoxication (smell of alcohol and can't walk a straight line) then she will be found guilty.
That's Maine law pure and simple.

Well, I learned something new. My sister was killed by a drunk driver and my other sister is an alcoholic who nearly killed a woman and her son while drunk driving so I've seen consequences from both sides and it's all horrible.

It's called a breathalizer and/or blood test. The results show the blood alcohol content. The police can only testify as to the probable cause aka the reason for the stop. Most police cars have built in cameras showing the cars they are following.

It will never go to trial. Unless the prosecutor wants to make an example of her, she'll cut a deal to avoid the legal fees and move on. Maybe even do a PSA about not going to Maine on vacation.

Why all the anger? She has a right to a trial. We are still presumed innocent until proven guilty in this country. Drunk Driving has become such a serious crime in the country people are forced to testify against themselves by having to submit to certain tests that can incriminate them. Those tests prove your guilt. No other criminal act works the same to get someone convicted.

They are making the alcohol limit lower and lower; so if you breath it, you will test positive. I try not to have a drink when I'm driving. I'm usually w/my kids and you never know how your body and mind are going to react. I might have a drink on a special occasion but my husband does the driving; one drink is good enough whether you're driving or not. I can't understand why people just gush drink after drink and get into a car and drive. I'm surprised the police aren't at every bar in town. Wouldn't it be better if we got people before they got into a vehicle. Give a person the breath test before they leave the bar; then they can call someone. In Florida, there is something you can sign up for and pay a membership for and they help you out of you have drunk too much.

You get a jury trial if you don't plead out.
She's sticking with Not Guilty and I'm pretty sure
anywhere in the US you will be entitled to a jury trial.
DUI is a felony and some states give you prison
time on the first offense. If she refuses a deal and
goes to trial and loses, the judge won't forgot the
time and money she cost the good state of Maine

Breathalizer testing is not mandatory, a citizen "can" refuse it. When you do refuse, you automatically get the ticket. It's the charge that you can deny and claim not guilty to in court. And Yes of course, if she is guilty she needs to accept her fine and punishment. But, smart people do contest a DWI because of all the damage it does, IF you can afford the attorney. And IF you are guilty and beat the charge, let that be a lesson, you can kill someone when you drive drunk.

I don't drink, so it will never be a problem for me. I just don't understand a jury trial for a DUI. A cop gives you a breathilizer test and if your over the state limit you are guilty. It seems a jury trial is a bit extreme and expensive. The article doesn't say why she is contesting. But if she were drinking, she deserves all the consequences.

It "triples" your car insurance, it hurts your credit rating, in most states you must spend 24 hours in jail, in many states you are court-ordered to get substance abuse counseling, that YOU pay for, in some states you are court-ordered to pay for cost and installation of a breathalyzer in your own car before it will start. I live in Maine, and more than likely, Ms. Struthers will beat the rap. Most OUI (up here, we call it "operating under the influence") cases don't go to jury trial--looks like Sally requested it. That way, if she's exonerated, it'll make news, and more people will know. Other people arrested for OUI in Maine include Aidan Quinn, when he was making "Empire Falls." His mugshot was in my hometown newspaper!
